Bankruptcy Fears and Misconceptions

Giving You the Facts About Your Bankruptcy Filing

Since bankruptcy laws were enacted, fears and misconceptions have prevented many from filing for debt relief. The changes in the law did not help dispel this misinformation. Actually, it made it worse. One of our jobs at the law office of bankruptcy attorney Jerrold W. Bartman, Esquire is to educate our clients on bankruptcy and give them the facts.

Albany and Schenectady residents know where to go to get factual information and overcome their fears and misconceptions about Chapter 13 and Chapter 7 bankruptcies. Contact us at (518)-864-4167 or toll free at (866)-559-7665.

At the law office of Jerrold W. Bartman, Esquire, we help clients overcome their fears of Chapter 7 and Chapter 13 bankruptcy and dispel misconceptions that include:

It is difficult, if not impossible to file for bankruptcy - Several years ago, people were encouraged to rush in to see an attorney before the new bankruptcy laws were enacted. Little has changed under the new laws and bankruptcy remains a viable option for most.

Financially irresponsible "deadbeats" only file bankruptcy - Hard working individuals often find themselves in life-changing situations out of their control, such as a serious illness or the loss of a job. These situations can destroy a person's finances, and can lead to bankruptcy.

There are creditors I want to pay back, so I shouldn't include them - While that is a noble sentiment, bankruptcy is not about emotional obligations. It is about discharging your debts so you can get on with your life. Bankruptcy filings are all or nothing.

You can only file for bankruptcy once - After your debts are discharged in Chapter 7 bankruptcy, you cannot file again for eight years. You can file a Chapter 13 bankruptcy four years after a Chapter 7, and two years after a Chapter 13 bankruptcy.

I am going to max out my credit cards and then file for bankruptcy - You probably think that you won't have to pay for the items you most recently purchased. This is incorrect, and at worst, can lead to serious allegations of fraud. Your trustee will review not just your possessions, but when they were purchased.
